This could be the river through Seaview Terrace tonight. 4-6 inches can be over 6 feet of water crashing into our flood plain, flood zone on all 3 sides. Four years of City Hall pulling the trigger in the game of Russian Roulette forced flooding to Seaview Terrace. Please let Becky Gibbons survive. City Manager Joe Slocum is fully aware of the water crashing into her prefab ranch on a slab. Almost took her car away in 2009 with the illegal snow melt from all the sites that Joe Slocum allows to illegally pile plowed snow ALL winter. Heavy seasons have wiped us out. Any event can be our last. Ruthless City Hall officials, City Council and Planning.

Crass/Offensive but it's Hurley World

Belfast City Councilor Mike Hurley promotes forced water slaughter to residents private property. Fabricating a mythical stream as a sound reason to drown and destroy, the flood plain, flood zone of Seaview Terrace on all 3 sides. City Council, Mayor, City Manager and City Planner support slaughter. Here's Johnny- Belfast is his stage, Seaview Terrace his reality victim unable to escape out the bathroom window.

Below is the local ordinance that City Hall uses as a reason to slaughter us. Hiding all documents that prove there is not a "natural outlet" running through our private property. Sick officials. I prevailed and nailed the original development plans. A ditch ran through here- probably dug in the early 60's to take the runoff off from the newly constructed Route 1 bypass. Before that, Seaview Terrace was an apple orchard.

It would be sick enough if there was a private property stream running through that they chose to use instead of building infrastructure. So this is insanity by the mass- #1 is City Planner Wayne Marshall, characterless, cold and calculating. #2 a toss up between  City Council Mike Hurley ,City Manager Joe Slocum, and City Attorney Bill Kelly. Code/Zoning Todd Rosenburg takes the next slot. Route 1 north and south highway nasty runoff, more roads, roofs, parking lots, totally polluted and coursing through our properties and into our beautiful bay- untreated. Super fund sick.


Stormwater and all other unpolluted drainage may be discharged to such sewers as are specifically designated as storm sewers, or to a natural outlet approved by the city.Industrial cooling water or unpolluted process waters may be discharged, on approval of the city, to a storm sewer or natural outlet, if in accordance with regulations of the state department of environmental protection.

Earlier this spring, Hurley started watching people around the world put their own versions of “Happy” on the Internet, including the one done by young dancers in Tehran who were thrown into prisonshortly after the video was made public. He was enthralled by the sight of all the regular folks dancing to the infectious pop song and wanted to make a video in Belfast. He and downtown promotional group Our Town Belfast worked to get financial support from underwriters, and by April they were ready to start production.

I come back and am not messing around in the second open to public. They must have been wetting themselves when I came up to their thrones. Click 6 for open to the public, they speak about me in communications (7) I'm back- click on 11 and into communications again. Hurley tries to dominate me. Not.
They rip into me. Watch it all, my neighbor joins in too. This one they have choreographed a mess with manipulations and with holding simple public documents. Forcing me to re request and re request for the same documents. Never to get them and Council refusing to validate validity of documents. This mess here is a simple request for 7 zoning conditions for snow removal at 7 sites. 51 copies Slocum says- files, maps- What The... No I've been done this rabbit hole too many times. Hand me the documents- Slocum refuses because they are not there. I'm home watching as they attack me. I come back for the second open to the public, click on #11- I am on rapid fire with fact after fact- then listen to Hurley- "if we want to put it on the agenda- we put Seaview Terrace on...and then he fades. At that meeting on 1/4/12- the City Attorney Bill Kelly spoke for City Council and ran out when I questioned him. City Council immediately voted to take not further action. Bang, bang. Listen to Slocum go back to his mess again, and defending that there was a stream there before the developer bought it and moved it. Hogwash. It was a ditch and he moved the ditch. For kicks and giggles- let's imagine it was a stream. Once it's moved it is not natural. Ergo not at NATURAL outlet.)

Back to 7/1/14 meeting- Hurley  takes liberty to slam me again and again, no difference here. He says I have dominated for 4 years. Preferring this to court where he has carte blanche City Attorney and tax payer dollars to break me. They want me to take me out financially in court. A friend told me of another similar flooding to a wealthy woman in Bar Harbor/MDI. She was into 10 million in legal fees 4 years ago. Evil officials/ Hurley comparing his property on top of Belfast (HIGH St. to the basin of their cesspool- Seaview Terrace. Neighbors liking this nightmare do not own "stream" property and are clueless to the drowning. Turn on the news. We're dead. City Manager Slocum, Council Mike Hurley and Roger Lee go back to denial and entitlement drowning.

Later in communications- it turns to the school officials dysfunction- just like Belfast City Hall. The students suffer, the residents suffer/ Hurley refers to the very same corruption tactics he and City Hall use in committee's and delays. Oblivious to the irony. Simple madness.

Which one is it? An all-encompassing office complex or the new Grand Canyon?

Below is my 1 foot high 2 foot wide private property drainage ditch after wild rapids swept through for over a week in spring melt 4/2011. My first spring, with this undisclosed hell where water and streams were my number one concern. All properties showed/disclosing water were rejected by me in writing in 2010. They sold me hell. Paid cash, flood zone not even disclosed. Property Inspector was in cahoots with agents. Inspected in 4/2010- water and unstabilized banks not disclosed. Below this is the water forced into Seaview Terrace after a one inch downfall, previously dry.

Below the map is the same 1 inch where neighbors runoff is illegally sent to me. Done so by the City of Belfast Public Works illegally digging ditches on private property to send accumulating run off to me. Against Maine State Law too. My house is the gray split level at the end. All coming to me. The red colonial next to me does not own "stream" property, nor the next and last house (not pictured- but the stream "Liker". Those sections are owned by Mid Coast Mental Health. The last picture is another path forced to my back yard from Midcoast Mental Health, The Annex and Wight St. Merging with it goes down another 200 feet to a culvert merging with more water into a culvert and under Northport Ave . Easy to back up and flood us. That huge culvert at the top couldn't handle the melt of 2009- crashing over and almost taking long time resident, Becky Gibbons car with it. City Manager Joe Slocum commented to me that it could have taken her house off it's foundation. But, so what, who cares. ME!

Save Seaview NOW Email sent 6/30/14


Below is the 4th request from 6/6/14 FOAA.  At the 6/17/14 City Council Meeting- I demanded for this request to be fulfilled. Belfast City Attorney, Bill Kelly and Code Zoning Officer Todd Rosenburg were at the meeting, not on the agenda. An executive meeting followed. Low and behold, the next night, Wayne Marshall, Belfast City Planner, advised the planning board to vote Seaview Terrace against rezoning Seaview Terrace into the new zone of R3 clearly because I caught them breaking procedural Maine Law for Comprehensive Plans (cited below). My FOAA for this information is relevant to the whole and still stands. Below was sent on 6/30/14 cc'g City Council and Mayor.

City Manager- Joe Slocum,

4th request- On 6/18/14 The planning board vote to reverse the proposed rezoning of Seaview Terrace to R3 .

However, per FOAA from 6/6/14 mandates response to ascertain how the proposal to rezone Seaview Terrace to R3 was approved by the planning board in the first place.  For clarity- respond specifically to #1 & #2.

1. Respond via email today- Members of the Belfast Planning Board approving PROPOSAL to rezone residential Seaview Terrace to R3- Healthcare and Housing. (Advise to all recipients on this email) 

 2. All the information provided to "persuade" the Belfast Planning Board to approve the proposed change to rezone Seaview Terrace to R3, Healthcare and Housing. Per Maine State Law Comprehensive Plan cited below, 


Pg 267 “However, even if a municipality is WILLING AND ABLE TO FINANCE SUCH A PROFESSIONAL STAFF, the desired flexibility is still not assured. A PLANNING BOARD, WHICH IN MAINE IS GENERALLY COMPRISED OF LAYMAN, MUST UNDERSTAND, BE PERSUADED AND APPROVE ANY PROPOSED CHANGES IN THE PLAN. The procedure is further complicated and delayed by the statutory requirement that “that the public shall be given and ADEQUATE opportunity to be heard.”

(None of the landowners in residence prior or at adoption of the plan in 2009 EVER agreed to this rezoning procedure. City Planner, Wayne Marshall claiming he sent out letters is irrelevant.  This procedure was violated.   Pg 263 "LANDOWNER AGREES PRIOR TO A ZONING AMENDMENT, TO PERFORM CONDITIONS NOT IMPOSED ON OTHERS IN THE SAME ZONING CLASSIFICATION.”)

Joe Slocum, City Council and Mayor,

A few months ago, City Manager Joe Slocum confirmed in the early budget meetings that Seaview Terrace would be paved in conjunction with the water district's replacement the water line on Seaview Terrace.
Joe Slocum stated the paving would be in late spring or early summer.

The water district tells me the City is delaying the paving until fall. Furthermore, Joe Slocum does not want to spend 220k necessary for roadside sewer drainage. This is unacceptable. Please advise when Seaview Terrace will be paved with roadside sewer drainage.  Property tax dollars are mandated as a given for roads and upgrades. 

The City has been cutting corners by using our private property as an outlet for enormous volumes of illegal forced run off and snow stock piling outside covering many miles of impervious ground outside of Seaview Terrace for over 35 years. We are not a natural outlet, the "stream" is not a stream confirmed in 1987 by the Belfast City Engineer, Neil Finlayson in his written report to then Belfast City Manager, Wilma Moses. Neil wrote that theses are private property drainage tracts put in by the developer. NOT A STREAM.

The City has been slaughtering the private property, flood zone, flood plain of Seaview Terrace illegally and unethically. Endangering our lives at each event and snow melt. Joe Slocum refuses to prepare a mitigation plan for Seaview Terrace, not caring what happens to us. The City is misspending property tax dollars that are a priority for resident safety. 

Please save the residents of Seaview Terrace from this forced water slaughter.

To clarify-
#1- Exact date Seaview Terrace will be repaved with roadside sewer drainage.
#2-Rerouting all runoff from outside of Seaview Terrace on ALL 3 sides. See my map (below)
Rerouting  to Wight Street and to the City maintained sewers at the bypass can be done immediately.

Proposed zoning changes draw concerned comments from Seaview Terrace residents



BELFAST — Proposed amendments to the city's zoning ordinances prompted residents of Seaview Terrace to ask councilors to reconsider the changes out of concern the character of their street will be negatively impacted.
The city is preparing for a series of three public hearings on proposed amendments to zoning ordinances for areas inside of the Route 1 bypass. As proposed, the changes would reduce the minimum lot size for new buildings to a ¼ acre as opposed to the current 1/3 acre. Other changes would allow construction on lots with no road frontage, as well as reformat the ordinances to make it easier for residents to determine the allowed or prohibited uses in a given area.
During a public comment portion of the council meeting, several residents of Seaview Terrace beseeched councilors to reconsider a proposal to move the road into the Residential 3 zoning district.
The Residential 3 zoning district would allow medical offices as a permitted use, but the Residential 1 and 2 zones would not allow such offices.
Seaview Terrace, which is a dead-end road located off of Northport Avenue, has been located in the Residential 2 zoning district since at least 1985, City Planner Wayne Marshall said. The existing zoning ordinances state medical offices are a permitted use within the district.
However, residents voiced their opposition to the proposal to place Seaview Terrace within the Residential 3 zoning district. Dawn Marriner, who said she wrote a letter to the councilors about the zoning, said the road is not designed to handle large amounts of traffic or accommodate a parking area for medical offices.
She continued by saying having medical offices located in a residential neighborhood would negatively affect the neighborhood.
Councilors listened to the comments and urged residents to attend the public hearings that will be conducted by the the planning board.
The following night, June 18, Marshall discussed the comments made by residents of Seaview Terrace with members of the planning board. Marshall suggested the board approve a change that would allow Seaview Terrace to be moved into the Residential 1 zoning district as opposed to the Residential 3 zoning district.
Marshall explained that Seaview Terrace was approved a residential subdivision and all of the existing properties are single-family residences.
The planning board approved moving Seaview Terrace into the Residential 1 zoning district.
A public hearing for Residential 1 zoning will be held Wednesday, June 25; Residential 2 and 3 will be held Wednesday, July 2; and the Downtown Waterfront Mixed-Use district will be held Tuesday, July 8.
All of the public hearings will be held in the Troy Howard Middle School cafeteria beginning at 6:30 p.m. While the meetings will not be televised live, they will be recorded for later viewing.

City Planner, Wayne Marshall seems incapable of concern for the basic rights and safety of residents in the path of his visions. Denying basic municipal services of sewers, drainage and roads- infrastructure 101. Maine Municipal Association is the rule book reference for local government expectations. Property taxes go to basic municipal services first. Instead, City owned properties, equipment and the worthy are the preferred club and get funding for wants. While the needs of residents are denied.

The City Planner has destroyed many. His plans are sneaky and locked up in his office. The watershed residents have taken the biggest slam. Corruption in run off and zoning conditions, development is the fast track. Destroying private property illegally with that run off is the plan to rid the watershed area of single family homes. Marshall flat out wrote that in his visions with the Comprehensive Plan where Seaview Terrace was slated for R3 Healthcare & Housing " more of the current single family houses likely will be converted into professional offices"

The plan to take out Seaview Terrace was calculated with increasing force since the plan was adopted. Why illegally force volumes of runoff to the watershed resident's? The Captain Albert Stevens School, insanely built on a swamp, on top of the watershed. Floors now cracking.,All that money, corrupt planning/approvals, start to finish, DEP, Army Corp, Belfast City Planner and players. All damning documents locked in the City Planners office. Follow the water- illegal slaughter to the residents. Proved and confirmed by Belfast City Manager, Joe Slocum in 12/2013, clearly waiting for the 7 year statutes to run out with the support of City Council by taking the 5th per City Attorney, Bill Kelly, 1/4/2012.

Almost four years of rhetoric and bullying to avoid responding to my original request for the conditions of compliance. The 2 mandatory conditions that would have stopped all the illegal runoff from that site to the watershed residents.One was the runoff impact study to the water shed residents, the other, an inspection by an engineer of the completed storm water system for compliance. Both critical and never done The storm water system was not built to compliance and the inspection and study would have caught that.

Calculated improvements were done in the millions for future use of development (now coming to light). The runoff from that massive site, sent illegally to the watershed residents to speed along the extermination plan. Full throttle by allowing this massive site and all sites (over 12) to break zoning conditions. Plowed snow is to be removed off site. Allowing these sites to stock pile all winter, all to melt in sync to the watershed residents. Flood City USA. City Hall laughs the other way and blames Mother Nature. They beat on any resident that challenges them. Confident weaving of corruption/intimidation tactics. Cedar Street , like most in the area- flooding to basements that were previously dry. Easily over 10 thousand spent by the resident in sump pump systems. And without storm sewers in many areas- where do they drain to? Another neighbor or into City sewage lines. Both illegal, neighbors suing each other and those into City lines, forced into silence. So, so nasty and unethical. Hunger Games turned into Flooding Games, same greed except this is reality and death to your property and soul.

Seaview Terrace is not even in that path- but the receiver of all- from CASS/Muck across Rte 1 National Guard- forcing, ditching, culverts, under roads, through land into all 3 sides of Seaview Terrace. In 2011, after 8 months of bullying by the City Hall white collars, I went public. Marshall says in this 11/1/11 meeting, that this force flooding would be difficult to fix. Marshall knowing we should not be getting one drop of outside runoff into Seaview Terrace, Marshall citing ordinance vaguely to drain to a public waterway.

After my wrenching public plea to stop flooding us 52 minutes into meeting City Manager Joe Slocum tries to deflect from missing map and discredit me, that was only the beginning of the missing documents that Wayne must have hid when you hear him give the history of the development 56 minutes into meeting. When questioned by Council, Mike Hurley as to what is Belfast's Storm Water Ordinance, Wayne Marshall, City Planner and torturer of my life, states it directs to send storm water to nearest PUBLIC waterway- streams.  I have requested this ordinance since and he fails to produce it... he must be lying and Seaview Terrace is NOT a public waterway, the City has no right aways or easements...THIS IS OUTRAGEOUS!!Then Mike Hurley says this storm water flooding is Council's problem but then they vote to take no action in the 1/3/12 Meeting where they brought in the  City Attorney who had more public documents with held from me specific to my property. When I tried to question him he ran away and Council closed the discussion.)

I would find out later that month in 11/2011, on a surprise raid to City Hall, the original with held plans of Seaview Terrace proving the our private property drainage ditches were turned into a forced stream by the City. Not natural AT ALL and 100% corrupt destruction. DEP just as guilty. Commissioner Aho closing the corrupt investigation when I caught her with her head in the swamp. Claiming my private property ditch as DEP wetlands too!! Giving them regulation rights. Weave of the corrupt to the innocent and ethical.

Even in this meeting 11/1/11 meeting, Councilor Hurley says it's their job to fix. Guess the fix  was to pave over Seaview Terrace with the rezoning to R3 through inverse condemnation. Worse than eminent domain- the government avoids market value compensation by destroying through forced flooding and rock bottom compensation to property owners, if any at all.

Now that Seaview Terrace residents acted quickly, the Planning Board approved rezoning Seaview Terrace into proposed R 1. I sent an email with concerns as instructed to public@cityofblefast.org, all Council, City Manager, Mayor and City Planner. I attended the public hearing last night 6/25 and Wayne Marshall was playing semantics again, stating he did not receive any written concerns from the proposed R 1 public. Wayne refused to respond to questioning by Planning Chairman Paul Hamilton.

I read the email "Per Maine Municipal Association, property taxes are to go to resident infrastructure/storm water sewers. Per City Planner, Wayne Marshall "Examine how storm water is managed in through the area. City OFTEN LACKS ADEQUATE FACILITIES. This is a signfiicant neighbor to neighbor issue and could hinder the developments of professional offices in the area. Relying mostly on-site storm water management is both expensive and land consumptive for many uses."

The City has forced most storm water to Seaview Terrace illegally. We are not a natural outlet. More development will mean even more water slaughter to our private property. Wight St. sidewalks, huge developments on the Sanderson's parcels. From the Muck/CASS to National Guard down, illegally forcing into tiny Seaview Terrace. Probably even more.

Sending it to neighbors is not infrastructure. It's forced drowning. What is the plan to get all of this forced water out of Seaview Terrace and roadside sewer drainage for Seaview Terrace?"

City Planner, Wayne Marshall's response was cold. Many need basic infrastructure of sewers, but apparently not in his plans. City Manager Joe Slocum committed to repaving Seaview Terrace in conjunction with the water district who has advised water line work to Seaview Terrace in 2 weeks. The water district said the paving is in flux, Joe Slocum told them maybe in the fall?? And sewers for residents are too expensive- 220K. Even though the City USES us as a free sewer for 35+ years, destruction with no compensation. And City Hall just keeps kicking us! Belfast Planning Board Wayne Corey is right, Soviet Union.

Please spare me the public back lash.With holding information and basic rights  forced me into speculation and traps to make me look stupid and paranoid. Follow the water, that is the proof.

Who Says You Can't Fight City Hall?? Seaview wins R1 zoning


WHO SAYS AN ANT CAN'T? WHO SAYS YOU CAN'T BEAT CITY HALL?? Little Laurie Allen says I can and I will. I did and will until... Just got this in the mail. It's like a Gold Olympic Medal. Even more so- no one stood with me for 4 years, many joining in the social stoning or watching... until the final hour. Oh but what a win. Not over yet...still have to get their forced flooding out and demand infrastructure.
