Approval contingent on hospital receiving state permitsBelfast — Planning Board members approved plans by Waldo County General Hospital to construct a new office building on the condition necessary state permits are received.
The focus of the Oct. 28 meeting was addressing a few outstanding issues raised during a prior review of the construction plan.
Mike Hogan of The Maine Group Architects, speaking on behalf of the hospital, said two improvements shown in the plan will need approval from city councilors, but he wanted Planning Board members to review and sign off on them first.
One of the improvements would involve installing a flashing beacon near a pedestrian crosswalk. That beacon, according to Assistant City Planner Sadie Lloyd, would be similar to the one at the intersection of Route 1 and Route 141.
Additionally, a semi-dead maple tree that interferes with the location for an entrance driveway to the site needs to be removed. Three hawthorn trees will be planted in its place, Hogan said. Council approval is needed before the tree can be removed, he said.
Hogan said Maine Department of Environmental Protection is reviewing the project and the hospital hopes permits will be issued in the near future.
No comments were offered during a brief public hearing.
Lloyd addressed flood plain, wetlands and stormwater management, which required additional review. Lloyd said a portion of a ditch at the rear of the property is located with new flood plain maps and the hospital is looking at filling it in. Alternative water storage and drainage areas will be provided on the property, she said.
The hospital received permission to fill in the ditch after working with the city's code enforcement officer, Lloyd said.
Because some wetlands on the property will be disturbed as a result of the project, an application was submitted to DEP Sept. 28 for a National Resources Protection Act permit and Site Location of Development Act permit, Lloyd said. Planning Board members can OK the project with the condition that DEP approves it as well, she said.
As long as the stormwater improvements are installed as shown on the plan, Lloyd said the city engineer does not have any concerns. However, Lloyd said the city engineer asked, in the event any changes are made to the stormwater management plan, it be resubmitted for review to ensure it still meets city standards.
The new 20,000-square-foot office will be located across Northport Avenue from the hospital, on a lot previously occupied by a motel used as a training center and for temporary overnight accommodations for doctors. The building will be 38 feet in height, which takes into account equipment, such as air exchange systems, that will be located on the roof of the structure.
Planning Board members voted unanimously to approve the site plan and use permit for the project. They also approved a second motion supporting the installation of a flashing beacon and removal of the maple tree.

I've been uncovering corruption after corruption, DEP, EPA, DHHS, Maine Realtor Commission face to face with Mike Thibodeau, Chuckie LeRage, requests to meet with Chuckie and Mrs refused, Attorney General sends me back to Belfast City Hall- they tell employees not to give me any information and bury the public documents.
City Attorney Bill Kelly has sent many unethical letters to intimidate me, they try to stop me from speaking at City Council meetings (over 50), alienate me from the community with slander, then began having a police guard for me after I kept coming to meetings, City Council called me in as a threat to the Chief of Police, I had to go into the station for an interview and was cleared. An officer followed me outside after a meeting to "talk" to me and tried to convince me to step back, I said no, then he tried to shame me as a mother and I left. Another time the Chief and the same officer came to my house to "talk" to me. I invited them in. They had a tip that I was unstable and came to interview me. When I didn't cave, the Chief then tried to shame me as mother. Told him we're done and my kids are off limits.
I protest with signs all over, Chuckie, Olympia Snowe and George Mitchell- I was front and center when they came to Belfast. I tried Angus King, FBI, Hilary, Obama, Elizabeth Warren even Bill Maher when he came to Portland. JB Turner, FSS in almost every meeting I spoke at and sometimes with the FSS owners. They could care less- taking property taxes and targeted residents denied basic infrastructure and services.
The corruption is enormous and so easy to prove if others would stand up. City Hall tries and tries to get me into a legal battle but I know they will bury me and silence me. The attorneys spin and win regardless, as does City Hall. Tax payers foot the bill. And if Judge Patricia Worth is ruling, forget about it, no matter how much you prove. I had first hand experience with her in small claims and then googled her and saw a history of corrupt rulings. Her husband? John Worth III is on the WCGH Board of Directors with JB.
I've got 6-7 blogs of rhetoric corruption, spinning me like a top and hoping I'll drop. The secret Comprehensive Plan just passed this fall echoes the TPP tactics. I have nothing left to lose. I'll keep going. Public works nailed me good this winter with snow. Targeting my driveway and face to face refusing to move snow from my property but did it for the rest of the street. You have no idea.
Kicking a 54 year old Mom from a scary marriage got out and won rarely granted relocation. 500 miles to Belfast or Bust. Belfast Agents sold me undisclosed City Hall water slaughter hell in 2010. The property inspector DJ Brown also corrupted report. Damn near broke me when that flooding tore through my yard and took 1/4 of my backyard with it in 4/2011. All City Hall doors slamming shut. I was barely holding on.
I'm stronger than ever now and will not back down. The most hated woman in downtown, possibly all town Belfast. Even child hood friends bailed on me. I summered in Bayside since 1969 and built my own year round house there in 1997 and lost it in the divorce. I know lots of people and they look the other way or are implicated themselves. Article in the Bangor Daily News stating they had to wait 6 months for a demolition permit. As you read below, you will see, as an abutter On 4/17, I emailed in concerns for the demolition that were to be answered in the 4/22/15 Planning Board meeting when Mike Hogan gave his presentation for the addition. My concerns were not even read and not addressed. "

That motel is old and probably has asbestos.

On Mother's Day weekend, 5/10/2015 I watched in horror as they demolished the old motel, feet from my backyard, without any notice or precautions, doubtful if they even got the permit. Six months would have been August.

Note that the reporter (who knows me well and blocked me months ago when I told him he has sold out by not questioning illegal issues with the Annex site) doesn't question how they were able to demolish the motel without regulations... nor my concerns as an abutter, nor, nor, nor.... 6/1/2015 - I had sent this City employee, Nora McGrath, 2 emails to forward to the Planning Board. Why didn't Nora email me back and tell me that she would not do that? Very sad. A woman too. (6/13/15 Note- the emails (above and below) I asked Nora to forward are the email's concerns below the article that were originally sent to Wayne Marshall and others. I wanted to make sure the Planning Board was accountable and in receipt of my documented concerns before I called them out. I know most read my blog but that is subjective. I had hope for Planning member Wayne Corey (Engineer Degree) but he failed. When I was protesting outside Left Banks Books in 2013? (Olympia Snowe was there for her book signing), Wayne Corey approached me. He said he couldn't discuss planning issues that are destroying my property but he'd could charge me for construction to stabilize my property from future forced flooding by Planning... After that, I wrote him a letter of the corruption to my property and delivered it to the gym where he works out with my neighbor. Just to be sure Corey knew. That was over a year ago. I waited for him to be ethical- he has 9 kids to be a role model for. Failed. He knows and is still able to face my neighbor every day. My neighbor has his property flooded too- not as bad as mine, but bad. These "officials" pretend to be his friend.)

I see you are the administrator for planning board meetings. Please forward this email to the planning board as Wayne stated he would do. I want them to see these pictures taken 4 years ago. The erosion is much worse, several trees are coming down. In this new proposal, the detention pond will spill out throughout the buffer zone as well as pound through the illegal path to the huge tree with root exposed in 2011. The Annex stock piled snow over 50 ft high 100 ft long- maybe more, in that area. They have got to stabilize the banks on their side.

Waldo County General Hospital revises new office construction plans
By Ben Holbrook | Jun 13, 2015Belfast — Waldo County General Hospital asked for guidance from the Planning Board with regard to potential changes to the site plan in an effort to minimize disruption to the wetlands on the property.
The hospital plans to construct a nearly 20,000-square-foot office building across Northport Avenue from the hospital, on a lot previously occupied by a motel used as a training center and for temporary overnight accommodations for doctors. The motel is now demolished.
When Mike Hogan of The Maine Group Architects unveiled construction plans for the new building before the Belfast Planning Board April 22, he explained they would involve disrupting some wetlands on the property. He said the hospital's plans had been submitted to the Maine Department of Environmental Protection for review.
In an update before the Planning Board May 27, Hogan said MDEP will review the project as a common scheme of development. That means there would be three sites involved, Hogan said. Those sites include the location of the new building, the hospital site and an administration site that is just on the other side of Fahey Street.
Hogan explained the hospital has to report to MDEP all of the impervious coverage done to the sites since 1971. If the hospital has more than three acres of impervious coverage then it will have to go through the Site Location of Development Act, which will extend the permitting process.
In addition, if the hospital disturbs more than 15,000 square feet of wetlands among the three sites being reviewed, then a Tier II permit would be required. To avoid having to get into a Tier II permit review, Hogan said the hospital is trying to minimize the disturbance to the wetlands where the new office building will be located.
He noted about 14,000 square feet of wetlands already had been disturbed when the hospital expanded in 1998. The preliminary plan presented at the April 22 meeting would result in the hospital disturbing more than 15,000 square feet of wetlands, he said.
The purpose of returning before the Planning Board May 27 was to show a selection of strategies developed to reduce the impact to the wetlands, Hogan explained.
Preliminary plans for the project called for relocating the entrance drive to 119 Northport Ave., reconfiguring the islands and parking in front of the new building, as well as wrapping a drive aisle and parking around the rear of the office building.
Hogan said the hospital would like to use common scheme for the parking to redistribute the required number of spaces across all three of the sites versus having to meet the exact number required for any particular site.
He said the hospital has no intention of reducing the overall number of parking spaces as a result of the new office construction.
The strategies developed to reduce the impact to the wetlands include shifting the new office building so that more of it is out of the wetlands area and making adjustments to the parking behind the building.
He said the hospital is leaning toward a scheme that would preserve parking behind the building for staff members but truncate an access drive that goes all the way around behind the building. Hogan acknowledged there was a chance the hospital would have to eliminate all parking behind the building in order to not disturb more than 15,000 square feet of the wetlands.
The board voted to allow the hospital to use a combination of its three sites to satisfy the parking requirements.
Hogan also requested and was granted permission to place temporary modular buildings to be used for meetings and training where the motel stood prior to demolition. The buildings would be about 400-500 square feet in size.
Hogan also reported the Maine Department of Transportation has no issues with the hospital's application, and will be issuing a traffic movement permit.
The new two-story office building to be constructed will house physicians and provide space for training and administrative offices.

provide an area in which health care facilities/offices and
professional offices are recognized as a primary use, and to establish
this area near Waldo County General Hospital.
Past, Current & Future Use
Waldo County General Hospital and the many physician offices that have
developed near the Hospital are now the prime uses in this area. The
Hospital underwent a significant expansion in the late 1990’s and
continues to expand. It is one of the key reasons people, particularly
retirees, from other areas in Maine and other states choose to live to
Belfast. Other health care facilities, such as the Tall Pines
Rehabilitation Center and Mid-coast Mental Health Services are also
located in this area. The Hospital likely will remain a key part of the
City’s fabric and it is important to allow reasonable opportunities for
the development of new health care related facilities, particularly
offices for physicians who want or need to be located near the Hospital.
It is noted that these active uses generate considerably more vehicular
traffic than residences, and such traffic could adversely affect the
desirability of the area for future housing development.
While the Hospital is the primary use, housing remains a significant
type of development in the area. Sea View Terrace is a long established
urban neighborhood, and single-family residential housing remains the
predominant use on Wight Street. Publicly supported housing, such as
Penobscot Terrace, Coastal Enterprises, and Huntress Gardens, also is
located in this area. While the City believes much of the current
housing will remain, in the longer term, more of the current single
family houses likely will be converted into professional offices, and
some of the limited amount of available land may similarly be used for
offices. The City believes it is appropriate to allow new housing in the
area, and there is a limited amount of land along Wight Street to
accommodate such, but it wants current and future residents in this area
to recognize that a health care office or facility likely could become
their neighbor.
The main goal for this area is to allow uses that support the delivery
of health care services. Thus, it is important that the City ensure that
other types of nonresidential uses, such as retail and non-health care
service providers, not be permitted in this area. The City now allows
such uses in many areas of Belfast, and the limited amount of land in
this area is too critical to the primary goal to encourage other types
of nonresidential uses.
@ 43:10 Karen Caswell steps up to speak to support the hospital. My house is the house she grew up in. Her father, Dr. Caswell was the original 1967 owner and began fighting the City for flooding that began. Another corrupt tale with the Belfast City Engineer report (with held from me). After Dr. Caswell died, Puzz Caswell, daughter in law and local corrupt realtor lived in the house. She even told me that the flooding is the City's fault but they won't fix it. She sold it to a banker (Moll) who sold it to Minister Tarpley, who sold it to me. Karen doesn't mention that. She still owns the lot next to me. Tried to sell it when I moved here in 2010- at 100k. After 2 years, she dropped to 25k and took it off the market. Has she made a deal since she isn't concerned for the trees that just fell into her lot from the stream? Seems so.
@ 45:32n Wayne tells the board he made his OWN synopsis of my requests, stating they were just received on 5/25. HE LIES AND LIES AND LIES AND THEY ALL KNOW IT. ALL OF CITY HALL KNOWS IT. ALL THE PLAYERS IN THE COMMUNITY KNOW IT. He has Mike Hogan get up to play his part. Hogan stating the banks are not hospital property but stating that the man he hired is investigating the property that the hospital DOES NOT own. It's all deceptive. Marshall brings an old map to show the stream is on my property. Even more outrageous because the map he gave to the engineer this past summer showed the stream was not on my property. The engineer used that map to get approval for the City to send more water to me with the illegal paving/culverting and ditching done the week of 9/8/2014 when they thought I'd be at my brother's funeral in Alabama. Bet heads are spinning in disbelief- you have no idea. Five years of enormous first hand corruption. Overwhelming with calculation. It's too much. The public will turn on me because they are sick of it. Most have, almost from the start.
The concerns that I sent at the first hearing were never read. SPECIFICALLY THE DEMOLITION OF THE OLD (1950) MOTEL AND REMOVAL OF ASBESTOS AND LEAD PAINT. Here is my 4/17 email for the 4/22 hearing that was never read. AT THIS 5/27 MEETING I STATE IT IS POINTLESS TO GO OVER CONCERNS. I leave and Wayne takes the liberty of paraphrasing and lying. Read my email from 4/22 then listen to him. He talks about the already existing building and concerns for that drainage??? The Board has that email and they let him do this, even support the lying after I just called them out on corruption.
For reader ease I will list the numbered 4/17 concerns that were for the 4/22 meeting here as well. They were not applicable to the 5/27 meeting as I was there to speak my concerns and focus on the drainage that will seep to the Midcoast Mental Health banks and falling trees. And of course, Hogan skirts that issue, by saying, not their problem. It's affecting me through MidCoast property... loop-holing and scheming to destroy private properties. After reading this, tell me why Wayne didn't read the email verbatim? Calculating manipulation and public tainting. It is clear to see he has mental illness that many in power have.

This is illegal under title 17:Crimes Chapter 91:nuisances subchapter 3 particular nuisances 2808. Altercation of surface water flow. Mike Hogan and DEP Commissoner Aho,
I have proven that my private property is not a natural outlet and all the water forced to it is not legal. However Commissioner Aho closed the investigation. Currently the new site construction of the Annex has recently been denied since the proposed plans and abutters notice I received in April. My concerns have not been addressed and although new plans must now be proposed under DEP requirements for common scheme of development, Mike Hogan did go ahead with the demolition this past weekend. I have no idea if lead and asbestos were present and sent airborne. Nothing was contained and as the building was demolished and piled, workers were spraying water on it with one garden hose. They did not have any hazmat gear on themselves, not even a surgical mask.
City Planner Wayne Marshall stated to the planning board that Mike Hogan was going to retool the application to minimize wetland fill for level of permitting. Today, I saw a man almost in my back yard tagging trees. He told me he was marking invasive plantings and to direct further questions to Mike Hogan. I have taken pictures- in the 150 ft length of my yard going back to the Annex, he has placed ribbons on 3 trees/bushes. That's it. I am questioning what the sudden interest in invasive vegetation is and of course am begging for you not to send me any more water. No one cares that trees on the Annex property abutting my property line are severely eroded, roots exposed and dangling, trees dying, and will fall into my property on top of the the destruction from the water slaughter with DEP approval.
I want this documented and hope for accountability and ethics. Flooding private property in a flood zone, flood plain is deadly. I don't know how you sleep.

#1-4 (my ref on the site plan) are in view from my backyard- 17 Seaview.
A. What is the noise level ordinance (DBA) ?
B. Will noise barriers surround the transformer, generator and possible pump station?
C. Will aesthetic screening buffer my view of #1-4?
#5 Explain this completely. It appears to be a new drainage path that will flow to my private property. This is illegal under title 17:Crimes Chapter 91:nuisances subchapter 3 particular nuisances 2808. Altercation of surface water flow. Unreasonable use of land that results in altered flow of surface water that unreasonably injure's another's land or that unreasonably interferes with the use of another's land is a nuisance.
#6 The power pole is not there any more. See pictures of pole pre Annex extension 2011. Is that being replaced in the same spot or is there a change?
#7. Explain this completely. This area is where an enormous tree is. Illegal title 17 again. See pictures for tree and erosion.
#8. This drain swale was to be filled in and graded per the site plans for the Annex extension in 2011. See pictures of plan and water slaughter. Illegal title 17 again. Fill it in.
#9. This is where Mike Hogan and Planning Board member Diane Beck confirmed site drainage into Midcoast Mental Health stream property. After the site was completed, this site is draining at #8. Wayne Marshall and Mike Hogan responded with rhetoric and a green pipe that I NEVER asked about. See the picture of #8 and erosion to another massive tree root system on private property. Title 17.
In the letter dated 4/10/2015 to abutting property owners, Wayne writes "The project involves the demolition of the former motel building on the site, an expansions of the current parking area, relocation of the existing access driveway from Northport Avenue to the property and SIMILAR CHANGES."
That motel is old and probably has asbestos.
10. Please advise if the motel has asbestos.
11. If so, also advise what the procedure is for demolition to contain the asbestos from.
12. Please advise in writing what all the "SIMILAR CHANGES" are by Tuesday 4/21. One day prior to the site meeting on 4/22/15.
13. What are the details and paths for all drainage, please send me a map with the full paths to the stream and which paths abutt my property.

Belfast City Hall and overwhelming projects with unknown recent ordinance and zoning in effect through the Comprehensive Plan are targeting private properties. I do the best I can to sound the alarms but I am treated like the Ebola virus. Humor helps me. I wanted to share this email and the pictures link. Maybe it will validate the corruption that I have been exposing. I haven't any idea if any residents in this email are connected to City Hall. It doesn't matter. I am transparent and innocent with family ties in Bayside since 1969 and more ties to the corrupt.
I honor Memorial Day by doing all I can to restore democracy. It is dangerous. I have nothing to hide. Belfast City Hall is destroying my last asset. They robbed us of the privacy and safety that my children and I thought we had crawled to 5 long years ago. The teachers at THMS and BAHS have given my son their all and an education and opportunity that he never would have received in NJ Exit 9 :) . I am forever thankful and indebted. Regardless of what Belfast City Hall and the players have done to me, my son will soon be on his way to the college of his choice after graduation next year. Thank you Belfast teachers. The poverty that Belfast City Hall has placed me in will most likely pay his way with endowments and/or FA.
I live on 18k a year and must have flood insurance(4k and 3k in property taxes for City Hall to slaughter Seaview Terrace and deny basic services of property taxes 101. High turnover to the delight of real estate agents keeping mum and selling hells) for a home that I paid in full with the last cash I had. A mortgage would have revealed that I was in a flood zone and I would have ran. I never would have bought it if all the disclosures and property inspections that protect a buyer were not corrupted, supported and sealed right up to the State level. I am not on welfare or assistance. I give my time to stop the corruption. It is exhausting and requires stamina. After my son graduates, I will have more options in activism. Proof of the destruction of the hard working middle class, the broken back bone of what made the USA. My education is street smarts with a life time of bullies.
The only reason I chose www.boycottbelfast.blogspot.com is because the downtown businesses chose to slap me in the face by awarding City Manager Joe Slocum Citizen of the year when I had been begging them to support residents as we support them. Mike Hogan is not responding (below). The planning board is hearing a new proposal for the new office building and parking (in XXXXX and my backyard) on Wednesday May 27 @ 6:30. The original plan is in the link below and I'll copy it here too. https://picasaweb.google.com/105736045670734847961/Annex?authuser=0&feat=directlink I understand Mr. MXXXXXX is a Maine Forester as well as an airport abutter with the City taking. I worry that Hogan is proposing that this tiny buffer strip (50?ft) of woodland (I would love to know if it's wetland designated as well) should be cut down because of invasive species. Thus allowing for additional parking and moving the transformer, generator and possible pump station even closer to my boundary. Certainly the tiny strip left will erode into the fake stream of City Hell. Trees roots are already heavily exposed, some are almost down into the stream as well as a massive boulder getting ready to block the width when it falls in.
Are there loopholes for invasive species that Hogan can use to do this? Furthermore, that site is R3- Housing and Healthcare (the old R2 zone). Since City Council voted the final zoning in for the new zone R1 (R2 into R1) and R3 in September or October (Marshall states September, Slocum states October) they refuse to update the City website with the final zoning maps that are legal documents. Lying verbally and in writing is apparently legal. Slocum and Marshall state they have made a mistake every time I have caught them over 5 years. Many times.
They "claim" Seaview Terrace is in the new R1 zone but I don't think so. Otherwise the maps would be updated. I actually think ALL of the old R2 (from Race? St over) has been moved into R3. Legally they can do that. Move the whole zone into the the same zone aka R3. They cannot pick out one area as they proposed to do to Wight St and Seaview Terrace, and put the rest into the new zone of R2 (old R1). I think they did that as a diversion. To keep the rest of the old R2 thinking they were moving into residential only- R1..
City Hall is buying time for as long as they can, for the appeals process to close? Probably has, normally it's what 30? days. Even on site plans and the corrupt construction doesn't start till way after that. Another real time nightmare of mine. I am mentioning the zoning because whatever the hell the zoning and new ordinances are for each zone is crucial. Residential must have ordinance prohibiting industrial equipment and parking lots being built 20 ft from our property lines. But if we are R3- healthcare and housing- we are a parking lot.
If Hogan has something with this evasive species- what about the airport woods and rail trail woods- all is at risk and certainly more than my ignorant mind would know. I'm a simple minded, mentally battered Mom barely able to stop myself from drooling. Deserving of all that rob my life, money, rights and privacy. I don't think so.

The fact that this Belfast Planning Board 5/27/2015 hearing for the "revised" plan of the WCGH Annex WILL NOT BE TELEVISED is corruption. Below was copied from the City Website (posted on Friday's prior to meetings). There is no doubt that Belfast City Hall and WCGH do not want the public to see the corruption that I have been laying my life on the line to expose for 5 years and counting. Regardless of any reason they give, the lies never stop.
First and foremost, update the City website to confirm that Seaview Terrace is zoned as Residential 1 and that the ANNEX must follow ordinances and zoning (setbacks, noise, lighting, placement of heavy equipment, stabilization of abutting eroding bank to 17 Seaview Terrace residential 1 property. I would estimate the current equipment and driveway to be 50 ft from my boundary. See pictures.

Ned Lightner does have back up to tape/broadcast meetings as I have witnessed before. Clearly there is no plan to do so. In fact, Ricki LeSans, Belfast City Hall Treasurer witnessed another attempt by City Hall to not televise an emotional meeting that I would be speaking at after the death of my brother on 9/4/2014. The City sent in the trucks, unannounced, on 9/8/2014 to do an illegal paving job on Seaview Terrace (no notice given)and send me more illegal water. They thought I'd be in Alabama, my brother's funeral was that day. I was home and watched in horror at the assault. All week long. The next City Council meeting was on 9/16/2014. City Manager Joe Slocum knew I would be coming to tell of the City using my brother's death to assault Seaview Terraceand tried to keep that from the public. I am sure the only reason he caved was because Ricki was there, a long time honest and respected City employee. And I had my own camcorder on me the whole time I spoke. Just in case the taped meeting had "issues". Too many prior meetings of emotional facts that I spoke at had "issues" with taping. Today I see the actual map now states "Proposed Land Use Areas." The real estate agents have listed 3 different zones on listings after the zone change. R2, R1 and Healthcare. 3 out of 12 homes. That's unethical and clearly due to your refusal to update the maps with final zoning for R1 and R3. Verbal mistakes are not legally binding. You may be making another mistake hurting my life and property. Advise when you will make the R1 and R3 final zoning on the City website and send me the confirming link with Seaview Terrace as R1 final zoning.
Mike Hogan will not respond as to why he has hired someone to mark invasive species on the small 50 ft buffer between my boundary and Annex driveways and industrial equipment. If he is planning to move the parking and industrial equipment into that small buffer, then that is an ethical problem that has no honor. If he is approved to do that, than my property was never DEP wetlands and DEP approved flooding to my private property. It is not a natural outlet and if this buffer is not wetlands than DEP had no regulation to approve the runoff. My boundary extends another approx 10 ft towards the annex from my fence and approx. 10 ft towards my fence from where the invasive man tied that pink ribbon on the tree in the picture below.

As you and City Manager Joe Slocum state frequently, you make mistakes.

Today I see the actual map now states "Proposed Land Use Areas." The real estate agents have listed 3 different zones on listings after the zone change. R2, R1 and Healthcare. 3 out of 12 homes. That's unethical and clearly due to your refusal to update the maps with final zoning for R1 and R3. Verbal mistakes are not legally binding. You may be making another mistake hurting my life and property. Advise when you will make the R1 and R3 final zoning on the City website and send me the confirming link with Seaview Terrace as R1 final zoning.
Mike Hogan will not respond as to why he has hired someone to mark invasive species on the small 50 ft buffer between my boundary and Annex driveways and industrial equipment. If he is planning to move the parking and industrial equipment into that small buffer, then that is an ethical problem that has no honor. If he is approved to do that, than my property was never DEP wetlands and DEP approved flooding to my private property. It is not a natural outlet and if this buffer is not wetlands than DEP had no regulation to approve the runoff. My boundary extends another approx 10 ft towards the annex from my fence and approx. 10 ft towards my fence from where the invasive man tied that pink ribbon on the tree in the picture below.

It is hard to avoid the conclusion that buffer strips have been used on occasion to soften up the opposition — namely, the residential property owners who oppose new industry, a freeway, or a new shopping center. The ethical problem here is one that each planning commission has to solve for itself. But if it is to carry out its function with honor, a planning staff does have the responsibility of presenting the facts and not relying on a pretty label. A buffer strip should be what its name implies and it should achieve what is claimed for it.
I have no idea what Hogan's new plan is. How am I supposed to address concern's? Why didn't you include the new plan as you did with the first plan? Please email it to me now.

I forgot to send the pictures of my once 2'x2' private property drainage ditch at purchase in 6/2010. Spring melt 2011 tore my property away. I had a 10' buffer from the fence to the ditch for mowing. All gone, a ravine with trees falling in.
The opposing side is Annex property and only 10 ft into the pink invasive ribbon. The exposed huge root ball is a massive tree on private property taken in 2011, ready to come down from where Mike Hogan corruptly sent the runoff from the Annex addition in 2011. He confirmed at the site meeting that the run off would exit further down, into MidCoast Mental health ditch property behind 5 Seaview Terrace. NOT 17 SEAVIEW TERRACE!!

This is frightening. It's on a Maine Real Estate Attorney's web site. Belfast IS doing all of these publicly, imagine what they are hiding ... think of all the "projects" for more underway- impossible to stop them unless the downtown is shut down. The downtown brought this on too. All about more for them taking our property and property taxes.

Section 5204 prescribes procedures for municipal takings
under the community development statute. These procedures are similar
to, but not identical with, the procedures prescribed under Title 23 for
local highway takings. Most significantly, community development
takings under sec. 5204 are not subject to the limitations contained in
30-A MRSA sec. 3101 for other non-highway municipal takings.
Specifically, a municipality may use the community development statute
to acquire owner-occupied residential property, even if the owner does
not consent, and use of property taken by the municipality is not
restricted to the specific use for which it was taken.
B.
Inverse condemnation is a term used in the law to describe a situation in which the government takes private property but fails to pay the compensation required by the 5th Amendment of Constitution. In some states the term also includes damaging of property as well as taking it. In order to be compensated, the owner must then sue the government. In such cases the owner is the plaintiff and that is why the action is called inverse – the order of parties is reversed, as compared to the usual procedure in direct condemnation where the government is the plaintiff who sues a defendant-owner to take his or her property.
The taking can be physical (e.g., land seizure, flooding, retention of possession after a lease to the government expires, deprivation of access, removal of ground support) or it can be a regulatory taking (when regulations are so onerous that they make the regulated property unusable by its owner for any reasonable or economically viable purpose). The latter is the most controversial form of inverse condemnation. It is considered to occur when the regulation of the property's use is so severe that it goes "too far," as Justice Holmes put it in Pennsylvania Coal Co. v. Mahon, 260 U.S. 393 (1922), and deprives the owner of the property's value, utility or marketability, denying him or her the benefits of property ownership thus accomplishing a constitutionally forbidden de facto taking without compensation.

I met a woman on 5/14/2015, who told me Belfast City Hall outright stole
approx. 10 acres of family property by the dam on the east side. No
compensation, just took it. Another woman told me her property is also
being destroyed and flooded by the City. Another woman told me of
similar neighbor chicken problems in-town, crapping all over her
walkway, sticking to her shoes and into her home, same neighbors kids
climbing her fence and allowed to build a deck and get a permit after...
neighbors clearly connected to City Hall. The 99% are getting angry.
Boycott downtown will be the only way to stop the corruption and players
from taking all. Three reporting's of corruption in a hour outing for
errands with strangers chit chatting. Imagine all the rest and the more
to come. Boycott.

5/25/2015 City Planner Wayne Marshall and City Manager Joe Slocum insist that Seaview Terrace was placed into the new R1 zone but the "adopted" plan on the City website does not reflect that. It was voted in last in September or October (Marshall says October, Slocum says September). Since then I have been demanding that the City website reflect FINAL zoning for R1 and R3. They refuse. Real listings have bogus zoning's in this whole area. The agents play stupid and refer inquiries to Belfast City Hall.

cited law for the Comprehensive Plan that a municipality CANNOT pluck
neighborhoods from a zone and place them in a different zone than the
rest of the original zone neighborhoods. We must all move into the same
zone together unless the residents of that neighborhood agree to go into

NEIGHBORS FINALLY TOOK NOTICE. ONE NEIGHBOR TOOK THE REIGNS AND WENT TO
BELFAST CITY MANAGER JOE SLOCUM TO ASK HIM HOW TO STOP THE REZONING.
Like going to the devil and asking him how to get to Heaven. I am
thinking all of the old R2 is R3. Legally they can do that. Why else
would they be refusing to make the zoning maps final? Why are listings
of other old R2 area's not reflecting the new R1? Why do residents bow
down to the bullies of Belfast City Hall? It is insane that we pay them
to rob us of our rights, property and lives. Forcing many to go along to
get along, life's too short. Be Happy, past the corruption onto your
kids, grandchildren... Shame on all the parents that enable the
corruption or are the corrupt.
