U.S. government files $629,816 complaint against Lincolnville dermatology business

PORTLAND — The U.S. Department of Health and Human Services filed a complaint in federal court against Lincolnville skin care center Maine Dermatology LLC, citing false Medicare claims made over a three-year period. DHHS, through the U.S. Attorney’s Office in Portland, said the Lincolnville skin doctors submitted $314,908 worth of false claims to Medicare from June 1, 2010 through Aug. 9, 2013.
Because the federal False Claims Act allows at least double damages, the U.S. attorney is asking for $629,816 in compensation. The complaint, filed in U.S. First District Court in Portland, outlines a settlement with the dermatologists.
“Based on the United States’ investigation, Defendant Maine Dermatology acted with knowledge or reckless disregard of clear guidance from the Medicare Program that its Medicare claims at issue were ineligible for payment,” wrote U.S. Assistant Attorney John G. Osborn.
Maine Dermatology LLC operates a skin care center at 2239 Atlantic Highway (Route 1), Lincolnville.
Through its attorney, Lawrence Vernaglia, of the Boston-based Foley & Lardner, Maine Dermatology LLC issued the following statement Oct. 28:
“Maine Dermatology, LLC Announces Settlement
Maine Dermatology, LLC has reached an agreement with the United States to resolve an investigation related to certain technical documentation requirements for the Medicare program. The practice does not admit any improper conduct as part of the settlement and there were no patient care issues alleged.
“Maine Dermatology’s providers help patients achieve healthy skin through early surveillance. They strive to provide thorough skin examination and develop individualized treatments to meet each patient's unique needs. Their top priority is providing patients with the highest standard of skin care in a professional and compassionate manner.
The settlement agreement will permit us to remain focused on providing our patients with the highest quality of care. It has always been the intention of Maine Dermatology to comply with all requirements of the Medicare program. We appreciate the opportunity to work with the United States to resolve this matter. We thank all of our patients for their support throughout this process.”
Medicare is a federal insurance program that provides health insurance to approximately 50 million Americans, most of them elderly or disabled, wrote Osborn.
“Under Medicare, any services billed must be medically necessary, and any provider billing Medicare must have documentation showing the medical necessity of those services,” he wrote. “Under Medicare, a participating provider can bill the program for evaluation and management services (“E&M services,” also known as office visits) provided to a patient on the same day as a separate procedure or procedures only if the provider can show that the E&M service for which it seeks payment is a significant, separately identifiable service from the other procedures provided.
“Providers must use Modifier 25 in order to receive reimbursement for providing E&M services to a patient on the same day as a separate procedure. When using Modifier 25, Medicare requires the provider to produce documentation, on request, demonstrating that the E&M service was a significant, separately identifiable service from the other services provided.
“Medicare regulations also require that providers accurately bill for the services that they provide. On claims submitted to Medicare, providers use Current Procedural Terminology (“CPT”) codes to describe the services that were provided to a beneficiary. The CPT codes for established patient office visits range from 99211 to 99215. The complexity of the office visit and/or the length of time spent with the patient determines the correct CPT code to use, with 99211 representing the shortest/simplest office visit and 99215 representing the lengthiest/most complex office visit.
“Medicare reimbursement increases as the length and complexity of the visit increases.”
For three years, DHHS maintains that the Lincolnville dermatologists, “in a significant number of instances... billed Medicare for providing E&M services to individual patients on the same day that it had also billed for medical procedures, despite the fact that each E&M service was not a significant, separately identifiable service from the procedures provided.”
An investigation by the Office of Inspector General maintains that the dermatologists billed Medicare for lengthier and/or more complex services than it had actually provided.

  • I went in there one time to inquire about a certain procedure. I was told I'd have to see the doctor. I wasn't looking to be examined at all, let alone for free, I just wanted some information.
    I repeated that I was only there to inquire about a procedure and, again, I was told that the only way I could get that information was to see the doctor, which was, of course, about $100 or whatever it was at the time.
    Maybe a judge could sentence them to take classes in ethics and humility.

    My husband had to go in there once to have 2 moles removed. We were told that they don't take insurance and we would have to pay cash up front before he would be seen. It was over $500 to go in, and that didn't include everything. I wish that the government would also look at and possibly further regulate what doctors who specialize in certain areas of the body are able to charge for services. It seems they are just given free range to charge whatever they want and make it impossible for many people to afford their services.
    Any person who continues to patronize this business is a fool.
    Wonder when they will check on our local hospital billing that way? It is only a matter of time. Sad when our medical system is so broken they try every trick to squeeze an extra dollar. Matters not if we pay it out of our billfold or Medicare. It all comes out of our pocket.

    I was seen there for a mole I had torn on my back. I was told by mr jensen that I needed 5 moles removed. He insisted I have them done that day. So I paid $900. No insurance excepted. It was painful and done in a questionable manor. I got a call a week later telling me I needed 3 re shaved because they tested positive for cancer. I never saw any paperwork staying this was true, but I trusted that they knew what they were doing. That's why we see professionals, right? I paid yet another $600. Later billed and harassed for over a year for another $600 and told that I hadn't paid in full. Once I told them to send it to collections they stopped. Needless to say I have horrid scars and was taken complete advantage of. I would tell anyone to stay clear of this practice. They are unprofessional in my opinion.
      How awful. He is a psychiatrist! You should sue the daylights out of them. Bet attorney's will be lining up at your door. I just wrote about this yesterday as sarcasm on my blog- "He is an opiate psychiatrist and she is a plastic surgeon. I even asked Dr. Charmaine Jensen if she offers laser treatment for acne. She said her husband does, she'll check with him!!! A shrink frying your skin and she'll fix the maiming. And double bill Medicare."

    ? my comment got deleted. Dr. Mark Jensen (psych) and Dr. Charmain Jensen (plastic surgeon) are not dermatologists either. She was treating my child since August. She knew who I was because I stand up up against fraud in Belfast. She told me she lived by me. They have young children too. I had asked her about laser for acne- she said her husband does that and she'd check with him. A psychiatrist masking as a dermatologist using laser on my child. Thank goodness this story broke before that.

    Midcoast dermatology practice to pay $630,000 in settlement

    BANGOR, Maine — Maine Dermatology of Lincolnville has agreed to pay nearly $630,000 to settle claims involving false billing to Medicare between June 2010 and August 2013, according to the U.S. attorney’s office.
    Medicare provides health insurance primarily to disabled and elderly Americans.
    Court documents filed Monday in U.S. District Court in Bangor said the practice billed Medicare for providing evaluation and management services to patients in violation of applicable Medicare billing guidelines, a news release from the U.S. attorney’s office said. The complaint alleged Maine Dermatology submitted $314,908 in false claims to Medicare. The complaint sought damages double the full amount of the false claims filed by Maine Dermatology, which cooperated in the investigation.
    The investigation was conducted by the U.S. Department of Health and Human Services, Office of Inspector General and the U.S. Attorney’s Office, led by Health Care Fraud Investigator Richard Fairfield.

      These two "dermatologist" are actually a boarded Psychiatrist and a boarded Plastic Surgeon both practicing as dermatologist
      Can I assess from this article that only 'midcoast dermatology' was prosecuted? No actual person? No one lost their license? No one is barred from excepting Medicaid in the future?
        That would be correct. In addition to being allowed to practice pretty much any type of 'medicine' they want to, physician medical records are not regularly reviewed. The Board of Licensure only acts on complaints on specific physicians, and then, records show, the penalty can amount to taking an online course in ethics. (It's Medicare, not Medicaid fraud).
      Don't these people realize they're not only defrauding Medicare but themselves and you and I? We all have to pay more taxes to cover the fraud including these people doing the deception.
      You have to wonder....what is higher....the price of actual medical costs or the cost of medical fraud

      The false claims are for medicare not Mainecare. The sad part is, they are still able to accept medicare and continue to take advantage of the elderly and the medicare system. Its disgusting! Patients should stop going there and the office should be shut down! These Doctors knew what they were doing and will continue to find ways to fraud the system to get what they want....MONEY! Its not about patient care to them its about every dollar they can bill.....
      So they need to pay double the amount of fraud which is good. This will (should) be a lesson to others yet ......
      The state’s investigation determined that the owner of True's Pharmacy in Oakland, State Representative Bob Nutting had over billed and failed to provide records for $1.6 million in Medicaid reimbursements the pharmacy had submitted to the state. Nutting was able to pay the state back only $433,000, leaving $1.2 million unpaid.
      Hoping soeone from mainecare is reading this and looking at it as well...
        Is Maine not associated with Medicare?
          It is Medicare fraud, not Maine care.

            Belfast City Hall and Realtors and Players terrorize the new life I crawled to in 2010. To start over in safety. I was targeted, not disclosing Belfast City Hall hell, they use our private property as an outlet and cover it up, with all the players including Property Inspector DJ Brown. Minster Tarpley filling in the ravine to make it look like the 2x2 private property surrounding my property on all 3 sides. I was adamant- number one NO WATER ISSUES/NO STREAMS.
            I drove 500 miles in 12/2009 to see the property being sold by MINISTER TARPLEY!!! I did everything right. No mistakes allowed, once chance to get us safe...contested child relocation is RARELY granted. I DID IT!! And back into hell, this time, packs of thugs- I never would have moved here . I had options and cash. Had.

          Like many targeted high turn over private properties in Helfast. Planning approves development to send their runoff and melt off to private properties. CASS, Midcoast Mental Health, Tall Pines,Volunteers of America, National Guard, MMP, Prays Homes, miles of Route 1 highway, north and south, Belfast Birches, Hilltop Birches, School St., Congress St. Cedar St., Wight St., all those properties, on and on all forcing into tiny dead end, 14 residential homes on Seaview Terrace. A flood plain, flood zone. No rights of ways, no easements and NEVER a NATURAL outlet. That is slaughter by water. Sell it to another. No more.

          Belfast City Attorney encourages neighbors to sue each other for run off from development because City Hall refuses to put in sewer infrastructure for this area targeted for Healthcare.
          The Comprehensive Plan end all for the targeted private properties. The TPP of Belfast. Zoning that was voted in over a year ago are still not public. City Manager Joe Slocum refuses to update the zoning maps on the website for what is NOW R1, R2 & R3. Many of this area's listings are corrupt- vague zoning if listed at all.
