I am retyping Commissioner Aho's letter verbatim so that I may add in my actual request and comments in blue for CASS School - Captain Albert Stevens School which is NOT  Robertson now renamed Sweetser School  AHO'S INTENDED DECEPTION. SHE CORRUPTLY ADDRESSED THE WRONG SITE BUT HER FIELD INVESTIGATOR TOM GILBERT INVESTIGATED BOTH- THEY ARE ON THE SAME PARCEL AND SHARE ISSUES. THERE ARE VIOLATIONS AT THE ROBERTSON/SWEETSER AS WELL BUT DEP GAVE APPROVAL!! CORRUPT AS ALL HELL, TOP TO BOTTOM.  See end for WBRC order for stormwater analysis to Mike Morse, DEP.

Dear Ms. Allen:

I am writing in response to a complaint you submitted to the Department regarding an increase in stormwater flow through your property located at 17 Seaview Terrace and the development of the Roberston School and Sweetser School properties in Belfast. No, I asked for CASS

(Here is my actual request to DEP-Thomas Gilbert (also in history below with more disturbing omissions  from Commission Aho) and after his false reporting see demand for full investigation to Com. Aho below- her response clearly sidesteps compliance violations documented with pictures and specifically advised of PRIOR to investigation.
Dear Thomas,

Per the below, I received an email from the City Attorney on friday, 7/20 evading that the Final Approved Site Plans for CASS (and others held by the City Planner) Please advise when the DEP can investigate the CASS storm water runoff. I traced it myself, the holding tanks at CASS- are flowing under School Street and down to me and the Roberson School was planned to be demolished in files, but was not. I see that when Chris Cabot was here, he did copy you on some of my emails. This is where I am with the City, 1 year and 3 months later. Wayne Marshall, City Planner, stopped recording plans in the registry, I am being told around 1999. He has stated that prior plans in the registry have gone missing and to my knowledge, no one is requesting copies to replace. The letter below to Jim tells more. Hiring an attorney as the City keeps trying to get me to do, knowing I am unemployed and at poverty level is impossible. Chris Cabot said if I can find specific outfall, the DEP can assist. The CASS School is it. Please help me.)


My staff investigated our records and determined that a Site Location of Development permit for this site was originally issued by the Department on December 19,2002, with the most recent amendment to this permit approved on September 8, 2006 for these properties. In response to your complaint, Department staff inspected the Robertson School and Sweetser School properties on October 17,2012 and on November 1, 2012 to ensure that the properties were in compliance with the stormwater plans approved by the Department. As a result of the site inspection and further review of the permit record, the Department has concluded that the stormwater management systems installed on the Robertson School and Sweetser School properties have been installed as proposed in their permit applications.

The Department understands that you are experiencing an increase of stormwater which is resulting in the erosion of a stream bank located on your property. Because  the school properties have been constructed per their plans approved by the Department in 2002 and 2006, the Department concludes that the stormwater problems you are experiencing are not a result or the approved construction on the Robertson School and Sweetser properties.

The Department takes these issues very seriously (Joe Slocum, Belfast City Manager said those very words in the 11/1/11 meeting- Corruption 101). Since it may not be possible (it is absolutely possible, I followed the water, 3 hours tops- see my map) to actually determine the source of the stormwater problems you are experiencing, your erosion control issues may be addressed by installing stabilization measures, such as riprap, along the stream bank to prevent further erosion. Stream bank stabilization measures may be authorized with a Section 8 Permit by Rule application(enclosed) from the Department. Please contact the Department at (207) 287-7688 with any bank stabilization project.

Ms. Aho,

I have not received any response for my 10/31/12 request for a full investigation and implementation of the storm water analysis. In this current email I am attaching 3 (3rd page on another email due to over limit) pages of a 17 page document that was removed from the file and replaced when Wayne Marshall thought I was done with the file. It is from WBRC Engineers to Mike Morse, Project Manager at MDEP, dated 11/7/02, in response to comments and concerns regarding stormwater management, erosion control, and groundwater for the Belfast Elementary Community School. The change of not demolishing the Robertson School is the issue and cause of flooding/severe erosion to the private property of Seaview Terrace. It is disturbing to see in this history of emails that I requested from Chris Cabot, DEP in July of 2011 specifically if there were any changes and approvals by DEP to the original plans. Never offering any information, forcing this survivor of domestic abuse down rabbit hole after rabbit hole. We crawled here to heal and begin again. My crashing children were robbed of my precious time and strength in this unethical never ending nightmare. If Sandy hit here, Seaview Terrace would be gone. Every day I have hope we will be saved.

A. Item 6 lists the ordering of the offsite drainage study to the unnamed streams watershed developments (Seaview Terrace) and to date is in violation of compliance. Please order study and advise.

B. It is stated that due to the change- the impervious area of the Robertson School is the only stormwater runoff that will not go through the million dollar stormwater sewer improvements via Miller St. . Tom Gilbert's inspection was false, clearly the stormwater from other areas (at least 3, including the huge detention tanks) draining to the unnamed stream (Seaview Terrace) and were not approved and are also in violation.

I am sure there are more issues that I have not addressed. I have many more documents that were hid. This is my only asset, our home, our not secure security that was dumped on us without ethics or disclosure. Please advise.

Furthermore, prior to your investigation, I told you about the water coming down from the detention pond, along Sweetser School, merging with another origin unknown probably from "The Muck", coming to us. I told you about the culverts at Belfast and Hilltop Birches. I asked to be present for the visit to make sure you saw all my concerns. You rejected that. You didn't include these top concerns in your report .  Now, you're taking offense that your investigation was half-*****, and asking me what my concerns are? That my concerns are not clear? I have a documented blog with facts and maps that you have access to,  and this email is a history in itself.

To be clear, I have gone above and beyond in trying to get assistance from the DEP in unraveling this nightmare. It is very upsetting. In my the communications in this email from 7/2011 with Chris Cabot, the DEP has had this information all along, approving the flooding of my neighborhood, my private property which is DEP regulated wetlands, and never shared that with me. Sending me down rabbit hole after rabbit hole just like the Belfast Officials, almost breaking this beat up Mom. Your call this morning asking me what my concerns were are cause for a intervention. I won't keep chasing this tail. It doesn't seem legal to me that the DEP can approve flooding to my private property via the  "forced channels" and "un-named" stream. It was easy enough for me to follow the enormous path of stormwater water. It is ridiculous to think that the DEP wouldn't approve without knowing where it goes. Did the DEP also approve the water being sent here from Mid Coast Mental Health ( right next to us), Tall Pines(right next to Mid Coast), Volunteers of America(Across the street from Tall Pines), up and down Rte 1, across Rte 1, The new Annex.... The stream is DEP wetlands, under DEP regulation and the DEP is approving the destruction of it on my private property without right of ways or easements and has tortured me enough. To think that the DEP has approved the ruining of my property, my new beginning makes me sick. Our lives are endangered every storm/spring thaw with a seal of approval from the DEP. How do I fight that? I came to the DEP for help, the protector of the stream....

I know you are only the messenger and maybe your investigation was more complete and edited. I don't know. I am only a mom who moved her battered kids away from abuse to begin again. Please make this better, get the stormwater out of here and pressure Belfast to fix the flood zone destroyed roads with proper drainage. Please do not send me down any more rabbit holes or ask me what are my concerns. The DEP and Belfast are holders of the information and approvals and have made my life hell.

Tom,

Attached are pictures I took yesterday at the "new elementary school in Belfast" ie CASS, Captain Albert Stevens school. The exit rip rap swale picture you attached did not have any water in it yesterday and is a whole issue in itself. Your reporting of not seeing any erosion at this site is of what use to the erosion and danger at Seaview Terrace. Belfast approved and spent 1 million in Miller St stormwater sewer improvements to handle the storm water from CASS and that is the bottom line. I have yet to receive proof of any CASS stormwater going to Miller St, it seems to be all coming to me without any improvements, easements or right of ways. This has been a volleyball game of unethical proportion and corruption.  Yet, I still stand. A full investigation needs to be ordered and the ordering of the stormwater analysis that Wayne Marshall secured 5k from SAD34 and never implemented. The pictures will support what I believe to be a sham of an investigation. I have advised Governor LePage that I asked you to copy him and wait for your confirmation of such.

Tom,

There are many issues here that are problems. I can see from your report and pictures that I am encountering another exhausting challenge against bureaucracy. It is clear, that although approved, the flooding from these approvals are destroying Seaview Terrace.
1.  It is clear that your pictures do not portray the reality and do not even depict the huge detention pond which is lined with rocks and has at least 2 points of exit- and pick up at least 1 other channel...to go to me? the un-named stream?
2. Add to that the approval not to demolish the school that would have allowed for greater stormwater absorption. DEP approves and increases the impervious amount to go to me? the un-named stream...
3. And you did not answer the stormwater paths from CASS detention pond to the bay. Please identify each stormwater outfall into the un-named stream. Then it seems that there is another offsite detention pond also accumulating for CASS- where is that and is that also being sent to me? the un-named stream.

Those are a few that come to mind right now. I do not wish to come across so harsh but I made the mistake of hoping again. Please copy Mick Kuhns, Ms. Aho and Governor LePage on all and confirm such. Thank you.

This is so unfair to put this burden on me, a single mom, income of 18k, being forced to spend thousands of that on this corruption, keeping me from making a better life for my abused children, it's just awful and keeps getting worse.

I am writing in response to your complaint regarding stormwater flow originating from a new elementary school in Belfast.  Attached to this message is a copy of the original permit issued for this project as well as the most recent amendment.  Unfortunately, we are unable to produce copies of full-sized plans.  If you would like to review the approved plans please contact the department to schedule a day and time to review them.   
Other information such as stormwater flow rates are available for review as well.
Also attached to this message is an inspection report from an inspection conducted on 10/17/12.  The photos in the inspection report were arranged to begin from the highest elevation of the property, progressing down to the exit point of the majority of stormwater from the site.  Please contact me with any additional inquires.

Thanks you for your update yesterday, 10/2/12. I see in the information I sent below (sorry to have repeated some yesterday- haven't revisited this email) I did not list and important change. Mr. Sanderson (all his documents were pulled from the file upon my first inspection) I specifically asked Wayne Marshall to see the all the communications with Mr. Sanderson and he told me there were none. He said they simply dug a ditch for him. I spoke with Mr. Sanderson and he said it took 3 years of his energy and time for a ditch. Mr Sanderson said that he stopped pursuing because he was told that the storm water analysis would resolve all concerns. The analysis was never done.

I heard this yesterday, please correct me if I'm misinformed.

1. You will review the CASS files and aerial views this week.

2. You hope to site visit within the next 2 weeks. I asked to be present for your visit, this is pending. Please advise what day you are visiting. If I am not invited, I would like to know the parties that are viewing the site.

3. I will receive a full report of your findings.

If you need anything, please call. I will follow up on Weds., 10/17 if you have not contacted me. Looking forward to resolution big time. Thank you for your help.

Joe Slocum,

Specify exactly what you have ready. For clarity,  Final Approved Site Plans for CASS, VOA, etc. Please name each one. Again, I was told the final approved plans were ready with the files and the final approved plans for CASS were not there after 6 hours of searching through files under supervision. Marie could not find it either. You have stated that files and documents are all over the place and that's just the way it is. This is your system and your responsibility to provide these documents requested. Wayne has stated that a final approved site plan or plans that are in registry of deeds is not there and he does not know where it is. Therefore, as City Manager, you should be concerned about missing vital City documents and take action to replace them. Please gather for inspection, in one pile,  all the final approved site plans requested,, advise which ones are missing and when they will be available for viewing (I do not wish to know the steps required to get them- you tend to over word). And again, advise when the storm water analysis will be done. Telling me, over and over that the storm water analysis was not done is not an answer to when it will be done.  Please stop wasting my time with vague responses. I want answers direct from you, the City Manager. No more excuses, delays, or disguising. I have been tossed around for 1 year and 3 months trying to get this storm water public information that is crushing Seaview Terrace. Refusal to comply with written specific responses to 1-9, or using employee absent excuses is not acceptable.Please provide final advisement on this request in its entirety by noon, 7/16/2012.

Dear Jim,

 I did not contact David Ladd. If he is my contact please forward and copy me so I have his email. Senator Thibodeau's office was to get a message to DEP. Wayne Marshall is the City Planner for Belfast and holds the information on storm water and final approved site plans. He has been with holding and hiding. From what I can scrape up, the Captain Albert Stevens School is NOT draining it's storm water to the approved plan. I cannot get the approved plan. I traced the paths down to my private property stream on Seaview Terrace. I think the storm water was to drain to Miller St- as there was some information in the file on that. I viewed the file on and came back and asked to see it again, unannounced. The secretary, Marie gave it to me and there was volumes on stormwater that was not there the day before...fro DEP, The Army Corp, Engineer reports, etc. I was unable to get copies for all. I got a few.The Roberson School was to be demolished and was not. I see the storm water from the CASS holding tanks, crossing under School St and makes it way to me.  A storm water analysis fee of 5k was secured from SAD34 for a stormwater analysis. It was not done and the City Manager Joe Slocum will not "speculate" why. I am asking for the DEP to do an investigation on CASS.. I did draw a map- here is a rough to see copy- the storm water starts up at CASS, picks up Belfast Birches, LaGore Subdivision, Tall Pines, Mid Coast Mental Health and into Seaview Terrace/stream. Then, at the Volunteers of America Residency on Congress, the topography doesn't allow flow to me. They have culverted it across Rte 1 to the National Guard, sending it down to Prays Home and behind/along the side of the trailer park and who knows where back there, to come out and culvert back across Rte 1 and into the stream at Seaview Terrace, DEP regulated wetlands. There is another path from lower Wight St, coming behind the Annex of WCGH and into the stream. The Annex was approved by planning to drain into the stream in 2011 and that seems wrong plus the exit spot into the stream is not the approved spot. It is draining into my stream property and I cannot get those final approved plans. Wayne Marshall stopped recording his plans in the deeded registry of Waldo County. Weeks ago I was told that the CASS final site plans along with the other's were ready. CASS final approved site plan was not there and Marie could not find it. It has been 1 year and 4 months that I am unable to get storm water information. I am waiting for a definite response from the City Manager, Joe Slocum that he has the final approved plans but he will not commitI have more pictures and information on my blog.

In trying to sort for answers, these have not been. Some you cannot becasue I know now it is City.

Specifically, number 5 is paramount. Has the DEP approved any storm water paths to my private property stream? If so provide approved paths and supporting legal right of way to do so.

If not, please state that there are not any City Storm Water paths have been approved through my private property stream that is DEP regulated.

Currently under the Freedom of Information Request, the City of Belfast, Joe Slocum must provide me with City Storm Water Channels maps to my private property and the culvert crossing under Norhtport Ave. His 5 days to respond are nearing.

I am requesting your response within 48 hours.

Chris,

1. There is a huge culvert towards the end of Seaview Terrace/Rte 1, running under Seaview Terrace diverting City Storm Water to the stream. Do you have a permit by the City of Belfast for that?

2. On either side of that culvert, there are sump pump drains from 2 houses on the other side of the culvert, draining into the stream, did the DEP approve this ?

3. Captain Albert Steven's Elementary School- Please advise of your findings where Mr. Sanderson (a resident) got the City to reroute the storm water path and approved by the DEP.

4. What were your findings on the RTE  1 bypass to Northport Ave. and the changes in storm water diversion?

5. Where can I obtain a copy of the DEP approved paths for City storm water to Seaview Terrace, specifically the stream on my property?

6. What is my next step to demand a site visit and determination of recent rapid City storm water destructing wetlands on private property? Please provide a name and email address

I own part of the stream, the DEP is managing the stream, the City is eroding the foundations of major trees and the wet lands are being washed away from all of the City storm water forced diversion of man-made, mapped, channels through out the city with culverts. I have been waiting for your direction since June 2 and your answer is that you don't have the time. I am to put out thousands and thousands of dollars to shore up the banks of DEP managed wetlands. The banks on the other side of the stream belong to the MidCoast Mental Health, where the huge trees will fall into the stream and my property due to the erosion. The imminent disaster and flooding of residents from DEP managed wetlands that are not being managed is wrong.

I am unemployed, single 50 year old mother. I do not have money to stabilize the banks that DEP is responsible to manage and cannot. I have purchased flood insurance with what little money I have. Please respond to 1-6 within 24 hours. Too much time has passed.

Hi Laurie,
I apologize for my delay in responding to your emails. As I’ve said, we are very busy these days due to staffing shortages and it being the height of construction season.
I’m glad you have spoken with Tom Gilbert about getting a permit to stabilize the stream bank on your property.
I have reviewed our permit database, and yes, there have been some modifications to the hospital that were properly licensed. We simply don’t have the staff time to devote to exploring the area to determine if (and why) there may be increased flows in the stream. There are many streams in Maine experiencing erosion due to increased buildout and increased high intensity storm events. At this time, the Department is not going to pursue the issue further unless a complaint for a specific unlicensed outfall pipe is submitted. If you know of a specific new culvert outfalling into the stream, we would be happy to determine if the appropriate permit was obtained by the landowner.
I do understand that there is active erosion on the stream banks. If other homeowners along the stream would like to stabilize the banks to prevent further erosion, we can assist them with the permitting of the work.
If you would like to stabilize the bank by your property, please follow up with Tom and submit to him acceptable materials to acquire a stabilization permit.

Please, please respond. The City Manager, Joe Slocum came here and I showed him the severe erosion, serious root exposure on huge trees that 6 months ago had 4 ft of land in front of them, that land has been washed away, roots are dangling up and down the stream, soil washed out under, over, visibly all over. During his inspection, Joe commented that he does not see anything unusual and moved onto something else before I could disagree. Joe said he would be contacting you.

Someone from the wetlands preservation must come and take pictures and confirm the severity. I am stuck between the City not taking any responsibility and the stream being managed by the DEP- I need help ASAP.

My first contact to you was on June 2, please, I will be availabe for your visit, just tell me when.

Please tell me when you will be coming here. Your findings are intertwined with City storm diversions and need to identified. I did take care of the permit call with your co-worker. No need to respnd on the permit.

The City is looking to schedule a meeting including a rep. for the Waldo County General Hospital, because they have some real concerns too, towards the end of August. Please advise when you will be here so that I can coordinate with this meeting or at least get pertinent information in writing of your findings.

Hi Chris,

I think I received a message from you in regards to my permit. The message was broken up- cell phone.

Also, I am feeling like I'm in shark infested waters. I can't get answers from the City on any stormwater issues, Wayne Marshall, the City Planner is ignoring me. My City Council person, Marina Delune is telling me that I have bruised his ego and need to, in my words, stroke him... Not.

I know I have to handle the City work with him but what about the Rte 1 bypass, The Capt. Albert Stevens School and the WCGH Annex. Has the DEP approved changes to the original plans?

 Marina did confirm that the School storm water was changed, another resident has told me the Rte 1 bypass was changed several times, and Mike Hogan the architect for the Annex at WCGH said that when the annex was built, flooding occured in basements and was rectified. How?

He also said that at the culvert at Northport Ave and the stream, that the water came right up to road, but "luckily" didn't go over. I have asked for an education on that chamber- I'm thinking its wide open during heavy storm water and the velocity to keep it from goin over is what is sweeping away everything in its path. You have to see all the erosions, root systems exposed, trees ready to fall, that culvert will easily get clogged and we'll be under water in a NY second.

I've been at this with the City for 3 months and counting and have not been able to get one answer on anything. Please tell me what you are planning. Thanks.
