Zoning/Paving Paradise to Seaview Terrace by Brutal City Hall.

As if the 50 years of forced destruction is not enough. Seaview Terrace didn't go under fast enough. They were forced to pave and hated spending even a dollar on Seaview Terrace. They break the law and local ordinance without concern. Belfast City Hall is committing public murder, visibly and arrogantly. It is an incredible mini series of history repeating itself. For five years I have been sounding the alarm, humanity has left Belfast. A painful pill to swallow, spit at me instead.

Well now, after I posted on 2/15/15 @ 9am that Sloscum didn't respond yet- he has. Stating he is not responding. He must respond. Since Slocum states Seaview Terrace is R1, and has not changed the maps to reflect R1 (Slocum notified in September 2014 that maps were incorrect- see below) why not just change it immediately, state when Council voted Seaview into R1 and done. Of course this suspicious and Slocum makes it worse- every time and lies, lies, lies and blames.

Proposed zoning changes draw concerned comments from Seaview Terrace residents
The following night, June 18, Marshall discussed the comments made by residents of Seaview Terrace with members of the planning board. Marshall suggested the board approve a change that would allow Seaview Terrace to be moved into the Residential 1 zoning district as opposed to the Residential 3 zoning district.
Marshall explained that Seaview Terrace was approved a residential subdivision and all of the existing properties are single-family residences.
The planning board approved moving Seaview Terrace into the Residential 1 zoning district.

Today is the 5th day. Please respond to this basic information under FOAA by noon today.  It is a pity that your refusal since September to correct the maps as well as the new current maps showing Seaview Terrace as R3- Healthcare and Housing, has escalated to this. Full alarms and more mental beating to me. Big men and women. Beat away. I have nothing left to loose, you have destroyed the last I own and endanger my children, dogs and yours truly, every minute since selling me undisclosed hell in 6/2010.

The zoning voting for Seaview Terrace by City Council must have been in this 10/7/14 meeting, 10H-M. City Planner Wayne Marshall's map has Seaview Terrace in orange. Looking at that, I see the map legend. There is not any reference for orange. I think Seaview Terrace has been duped. There is not any discussion about this discrepancy or Seaview Terrace.

This FOAA request is straight forward and easily answered. City Manager Joe Slocum refusing to respond is highly suspect. In a few weeks, all the illegal snow mountains, poised and pointed to Seaview Terrace will be catastrophic. I believe this is the kill and the plan for Seaview Terrace takeover under R3 ordinance put into sneaky unknowns by the 1% and players. Prove to me that I am wrong, I am begging you to prove to me that I am wrong. SAVE SEAVIEW TERRACE.

 JB Turner of Front Street Shipyard now sits on the WCGH Board of Directors? JB and I we have been in the very same meetings since 11/2011.  I am trying to save Seaview Terrace and have been getting kicked ruthlessly by the City as the City bends over backwards with pursed lips for JB.

 JB has witnessed this again and again. I reached out to him several times for help and he does not care. No response. Ditto with Greg Dutch of Dutch Chevrolet. 17 Seaview Terrace is this Mom's blood on all the 1% hands.

Not one ounce of concern in the City Council meeting from Tuesday, 2/17/2015. Not one plan with Waldo County Emergency Management Dale Rowley to the floodplain, flood zone of Seaview Perish. I can't even get mail delivered. The City nails me with snow plowing. I can't keep up, shoveling by hand is endless and a heart attack is ordered. C*****  kindly offers to plow with his ATV but it is too much and will create a bigger problem.

21srt request for zoning Seaview Terrace dating back to 5/2014. This sketchy link has suddenly appeared on the City website- 2-Current Zoning Map- Zoning Now In Effect.

#2 shows Seaview Terrace in the R3 Zone. The response on 2/17/15 from City Manager Joe Slocum stating the Seaview Terrace is R1 must be supported with confirmation of this FOAA.  Combined with the forced flooding of massive snow melt- this is clearly intent death to Seaview Terrace.

As Joe Slocum wrote below, Joe Slocum makes mistakes and resents being called a liar. Five years of Joe Slocum's "mistakes" that are killing my property, my family, my life. Therefore, Joe Slocum's  verbal response is subject to "mistakes" and hence the FOAA above for public information of documentation of City Council specifically voting Seaview Terrace into R1 and the final DATED zoning maps reflecting Seaview Terrace as R1. 2/18/15- Joe Slocum- The FOAA request stands above. Below is supporting documentation for the same request sent for the 9th time on 9/12/2014 and STILL NO RESPONSE OVER 5 MONTHS LATER.

Cxxxxx Bxxxxx wrote to neighbors after his meeting with City Manager Joe Slocum, 6/6/2014 ..."Please note: The comprehensive plan was made up by a group of folks years ago who are no longer part of city government, other than perhaps Wayne Marshall, the city planner... The Comprehensive Plan is overall a strategic recommendation of general policy to accommodate growth and land use going forward. It is not set in stone nor is it a dictate. Not yet. The City Council several years ago made a few adjustments before adopting it in 2009 and moving it tho this next step in the process... Based on the public input, the City Council can adopt the Planning Board recommendations, or also make their own adjustments, and could also plan to hold their own follow-up hearings. In other words, both committees can change or tweak the plan; they can make changes to proposed zones and text language." 

Per City Planner Wayne Marshall's 5/30/14 email " I note that our Department is continuing to prepare amendments to the draft proposals to reflect direction provided by the Planning Board and that we will not be posting the specific Ordinance amendment proposals until such are complete because we want to ensure that the information provided to the public reflects the actual recommendations of the Planning Board, and not a draft document that may not contain all accurate information. "  Wayne's 6/19/2014 letter to Seaview Terrace residents "That said, we will revise the map that appears on the City Website for the proposed Residential 3 area by the end of the day on JUNE 20 to reflect the recent change by the Planning Board to identify the Seaview Terrace area as being in the proposed Resdential 1 zoning district." And more sneaky Marshall language not publicized at the 9/2/14 City Council meeting first reading of unclear zoning districts "Current ordinance provisions for the above zoning districts will be eliminated." I spoke at open to the public and specifically asked- "What does this mean and what is the effect? Council has not voted the plan in, or had public notice. " All took the 5th- no one answered.

2. City Council Mike Hurley's response was to announce me as a spammer at the 9/16/14 City Council meeting and denounce the City slaughter to me, my home and entire neighborhood. This meeting is riddled with corruption tactics- beginning with an attempt not to tape it because I would be telling how they used my brother's death to send in the trucks to do the illegal paving. Hurley make sure to state he did not know- he absolutely knew. I had told his buddy, School Police Resource Officer Gregg Stearns when Gregg spoke to me at the school on 9/5/14 as I was crying. My brother had died in Alabama on 9/4/14. They thought I would be at his funeral on 9/8/14 and sent in the trucks to do the illegal goat path paving. Sure Mike, anything would help the heaving, crater ridden, crumbling road. Just like all abusers, beat the hell out of the target and then give them a band aid.  See, isn't that better? I stopped beating you. For a moment.

 I speak at open to the public but am not as effective as I wish I was. I am also taping myself because I correctly deduced that the camera man Ned Lightner would not be there. He was not and for a half hour before the meeting, I kept asking Mayor Ash and Slocum where was Ned? They City Treasurer, longtime employee Ricki LaSans was there for the note of 4 million. She was taking it all in and Slocum was forced to call Ned in. He came minutes before the meeting was to start, disheveled and harried.

 The City has broken me and I get back up. Each time, they launch more abuse. I gave you the links that clearly show Seaview Terrace proposed as R3. I look to the City Website for accurate information and there are not any maps of R1 in the section of Planning and Code where they have always been.

The City Planner's maps and plans change with out notice. What he posted 8 months ago showing Seaview Terrace amended into proposed R1 is not on the the site anymore. Which meeting did City Council vote Seaview Terrace into R1? The map Wayne Marshall sent to me was Seaview Terrace proposed as R3. I have that. Don't waste time "securing" that. Proposed maps tell me that they are not final maps. Final is the key. Where are the final maps where Seaview Terrace is R1?

For the illegal paving to Seaview Terrace, you and Mayor Ash stated all residents of Seaview Terrace were sent notification of the meeting with you to discuss the options. I asked Rxxxxx Gxx, Bxxxxx Gxxxxx and Cxxxxx Bxxxxx- none received this letter, including me. Rxxxxx found out by chance from Mxxxxx Kxxxxx.

You barely mentioned it at the 9/2/14 meeting. You stated you were having a meeting with Seaview Terrace residents but you did not state the time. I figured you were setting me up in the meeting where I would ask and then I would bespeaking out of order and would have been escorted out by the police guard.

Instead, I came home and contacted a few neighbors. Since they did not receive letters, I sent you the below email that night. You did not respond to my email to confirm the meeting and tell me the time, that is more with holding of public information. A common pattern.

You sent the trucks in when you thought I'd be at my brother's funeral in Alabama on 9/8/14. We were not notified of the illegal paving beginning on 9/8/14.  Paving of streets are posted on the website and announced several times at City Council meetings. The paving was clearly with held with intent.

 Crucial public information has consistently been with held and or denied and our representative, Mary Mortier takes the 5th and votes to slaughter Seaview Terrace with more water. Abusing residents is constant. They fear challenging City Hall and go along with the corruption to get along. The exception is me.

Here is a bit of the history where I worked for 4 years for the paving of Seaview Terrace with road side drainage. Although you stated in 2011 it needed paving, I waited 3 years till 2014 for you to finally announce paving was being scheduled. I knew you didn't budget for the proper paving, you even stated after 3 years of delay that you didn't have the money for proper drainage. No problem giving the TIF to Front St though. I campaigned 3 years for that funding.  Keep beating on residents, lets see how that turns out. All for 1%, 1% not for 99%. Boycott is inevitable. Bad corrupt governing.

1a  When and who will pave Seaview Terrace? 
1b. Will the entire length of Seaview Terrace be repaved up to the Mxxxxx's private property at 49 Seaview Terrace. 
1c. What will be the pavement width and grade (depth)

2a  What is the plan for roadside drainage?
2b What is the City ROW from the road, 15ft? 20ft?
Current pavement width in front of my house was 15 ft prior to water line dig up. Water lines and sewage lines are on my half of the road. Opposing side would be the only side for under road storm sewer drainage or your proposed ditching destruction.  There are ponds roadside. 

3. What is the plan for the turn around? Currently there is none. It appears the private property of 49 Seaview Terrace allows traffic to use their property for turn around. It also appears that the City snow plows that private property and perhaps provides more illegal City maintenance.

4. Please respond before 8/2. There is a City Council meeting this Tuesday, 8/5 and I think it is starting one hour earlier than usual- 6 pm. When will the regular meeting leading into open to the public begin?

In this process could I make a mistake?  The answer is yes.  Since last winter the Public Works Director indicated he wanted to repave your street which I correctly reported out. I may have assumed that this was his next round which was finished over a month or so ago with funds from last years budget. When I actually became aware that we were going to do the job later in the year I really do not know. The Water District decided it wanted to get in there before we do and I understand today they are digging up the road to install a new water main. I always planned on getting engineering advice to evaluate the possibility of installing better drainage for the road. I understand that the money for your road is included in this years budget which was approved on July 3, 2014.  I have drafted and signed a letter to you and all of your neighbors.I hope to get the Street done as part of a package of other streets. The Public Works Director is on a 2 week vacation and after I speak with him and the engineer I will have a better idea of when we will actually pave.

To All,

I checked with a few neighbors- we did not receive any notification of any meeting for Seaview Terrace in City Hall with Joe Slocum tomorrow. Slocum and Hurley are a danger to residents. We didn't do this to Seaview, the City did. Hurley threatening us is serious. 

You are planning to send me MORE water and I will fight this until. It makes all of Seaview Terrace upset. How can you sleep?

Will Council be voting on the options, if so when?

Mandy Olver, Belfast Engineer for Seaview Terrace,

Seaview Terrace residents, to date have (not) seen these pictures of options posted in the Republican Journal today. The boundaries are wrong. This City made stream out of my private property drainage ditch is on my property. You are proposing to send harboring water from others to my private property. Illegal under Title 17.

The only option is option 1. An underground drainage system out to Northport Ave. Option 2 & 3 is sending harboring water to my private property. 

Please advise in writing that the only option is option 1 due to boundary errors and draining into my private property. My neighbors cannot approve this because it is illegal. As the consulting engineer recommending drainage to my private property, I believe you have been misinformed.

City Council Roger Lee can confirm my boundaries. He pointed out the stake across the ditch now stream. Please advise ASAP. Thank You.

 Thank you for your inquiry. I spoke to Wayne Marshall and he advised me that he has sent you  the Map showing that Seaview Terrace is R-1 three times.
Seaview Terrace is R-1. I do not know how to be any clearer to you than this. If maps on line are not current I will look into when I can  and if you are correct then we will get to that when we can.
 I have tried to help you in the past but I will no longer be sending information to third parties at your request.
I will be reviewing your request further, including securing a copy of the map that has been sent to you 3 times. You will get a further response form me withing 10 days. That will be before or on February 24th.

According to the City Website Seaview Terrace is showing in the proposed R3. The prior map showing Seaview Terrace  proposed as R1 is gone.

On September 10, 2014 Sally Jaskold spoke to Wayne Marshall about the mapping error. Wayne told Sally that Seaview Terrace is proposed for R1 and he still has not changed the map to reflect the R1 zone. The planning board voted Seaview Terrace into proposed R1 over 8 months ago.

Please have the City correct the proposed zone map  with Seaview Terrace into R1 ASAP. Please advise exact date that revision will be done and advise via email to Charles Beck, Kathleen Kearns and Laurie Allen.
